Experiencing the loss of a loved one due to someone else's negligence or misconduct can leave a family grappling with difficult uncertainties. There may be medical bills, funeral costs, lost income, and sudden changes at home. A wrongful death claim cannot undo the loss, but it can provide a legal path for seeking compensation. A family generally needs evidence connecting the defendant's conduct to the death and the resulting losses.

If you're considering a [New Mexico wrongful death attorney](https://bullionlaw.com/wrongful-death/), it helps to know what a case has to prove. The laws of wrongful death apply when death is caused by the wrongful act, neglect, or default of another and the conduct would have supported a personal injury claim had the person survived. A tragic death alone does not establish liability.

### 1. A Death Occurred

This sounds obvious, but a wrongful death claim starts with an actual death.

The case will usually involve records showing when and how the person died. Medical records, an autopsy report, death certificate, accident records, or other documents may help establish the basic facts.

### 2. The Defendant Owed a Legal Duty

The next question is whether the person or organization being sued had a legal duty to the deceased.

For example, drivers generally owe other road users a duty to act with reasonable care. A medical provider may owe a patient a professional duty of care. A property owner may have duties to maintain reasonably safe conditions, depending on the circumstances.

Without a duty, a negligence claim may have a serious problem.

### 3. That Duty Was Breached

Having a duty isn't enough. The evidence must show that the defendant failed to meet it.

For example, a driver who looks down at a phone and runs a red light. If that conduct is established, it could support an argument that the driver breached a duty of reasonable care.

### 4. The Conduct Was Wrongful

The laws for wrongful death cover death caused by a wrongful act, neglect, or fault. The underlying conduct can therefore take different forms.

It might involve negligent driving, unsafe property conditions, medical negligence, or another actionable wrong. The exact legal theory depends on what happened.

### 5. The Defendant's Actions Were a Substantial Cause

Sometimes more than one thing contributes to a death.

Another driver may have been involved. A preexisting medical condition may have played a role. Several negligent acts might have occurred.

The existence of another factor does not necessarily defeat a claim. The evidence must be examined to determine whether the defendant's conduct was legally responsible for the death.

### 6. The Decedent's Own Conduct Does Not Defeat the Claim

Questions about the deceased person's actions can arise in wrongful death cases.

The law presumes that a deceased person used due care and was not guilty of [contributory negligence](https://www.law.cornell.edu/wex/contributory_negligence). The facts of each case still matter, and comparative fault issues can become complicated.

The deceased's actions should be evaluated based on evidence, not assumptions.

### 7. The Claimant Has the Right to Bring the Action

Wrongful death cases have specific rules about who can bring the lawsuit.

Under the law, the decedent's personal representative brings the cause of action. The representative serves as defined by the wrongful death laws to help the beneficiaries.

That differs from having a relative file a lawsuit in their own name.

### 8. The Value of Lost Services Can Be Established

Not every contribution comes with a salary.

Someone may have cared for children, maintained a home, helped an elderly relative, or performed other valuable household services. Evidence about those contributions can help show what the family lost.

A family shouldn't assume that unpaid work has no measurable value.

A Wrongful Death Claim Starts With Questions, Not Assumptions

No amount of money can truly capture what a family has lost. A wrongful death claim is a legal process for determining whether another party can be held responsible and what damages the law allows.

If you've lost someone because you believe another person's conduct caused the death, don't assume that a lack of immediate answers means there is no case. Gather the records, preserve the evidence, and watch filing deadlines. A careful review of the facts can reveal whether the legal requirements for a wrongful death claim are present and what steps may make sense next.
