#  What Parents Can Do When an IEP Request Is Denied

You asked the school to evaluate your child. You filled out the paperwork, provided examples, maybe even brought notes from a pediatrician. And the answer came back “No.”

Having an IEP request denied doesn't mean the conversation is over. It feels that way — especially when you've watched your child struggle for months and finally worked up the nerve to ask for help. But a denial is a decision, not a verdict. And decisions can be challenged.

Knowing your options makes a real difference in what happens next.

### Why IEP Requests Get Denied

Schools deny IEP requests for a [handful of common reasons](https://www.understood.org/en/articles/why-your-childs-school-can-deny-your-evaluation-request). Understanding which one applies to your child helps you figure out where to push.

The most frequent reason is that the school doesn't believe the child's struggles rise to the level of a qualifying disability. Maybe they're performing close to grade level on paper, even if the effort behind those grades is enormous.

Other times, the evaluation itself was too narrow. The school assessed one area, say, reading, but missed signs of attention issues or sensory processing problems driving the academic difficulty. And occasionally, schools deny requests because they believe existing supports like Response to Intervention are sufficient. That reasoning has limits. RTI is meant to identify students who need more help, not serve as a permanent substitute for special education.

### Steps to Take After a Denial

A denial shouldn’t be seen as a dead end. There's a clear path forward, and each step builds on the one before it.

### Ask for the Decision in Writing

If the school communicated the denial verbally, in a meeting or a phone call, request a written explanation. Under the Individuals with Disabilities Education Act, the school must provide a Prior Written Notice that explains what they decided, why they decided it, and what data they relied on.

This document matters. It's your starting point for any challenge. Without it, you're arguing against a decision you can't fully see.

### Review the Evaluation Data

Go through every piece of information the school used to make their call. Test scores, teacher observations, classroom performance records, all of it. Look for gaps. Were certain areas left unassessed? Did the evaluators speak with you about what you're seeing at home?

Parents notice things that don't show up on standardized assessments. If your observations weren't part of the record, that's worth raising.

### Request an Independent Educational Evaluation

You have the right to request an IEE, an evaluation conducted by a qualified professional outside the school district. If you disagree with the school's findings, this is one of the strongest tools available.

In many cases, the district has to pay for it. They can refuse by filing for due process to defend their own evaluation, but they can't ignore the request. An outside evaluation often surfaces issues the school's assessment missed.

### File for Mediation or Due Process

If informal conversations don't resolve things, formal options exist. Mediation brings in a neutral third party to help both sides reach an agreement. It's less adversarial and sometimes faster.

Due process is the more formal route, essentially a legal proceeding where a hearing officer reviews the evidence and makes a binding decision. Parents can and do win these cases, but preparation matters.

### When to Bring in Outside Help

Not every denial requires a lawyer. But some do. If the school is stonewalling requests or you suspect the evaluation was rushed, outside advocacy can change the dynamic quickly. Special education attorneys and parent advocates deal with these situations daily. They know what documentation to gather and when to escalate.

A denied IEP request is discouraging. No way around that. But it's also a single step in a longer process, one where parents hold more power than most schools let on. Get the decision in writing, examine the data, and don't be afraid to challenge what doesn't add up. Your child's access to support depends on someone being willing to keep asking. That someone is you.
